Einer R. Elhauge is the Carroll and Milton Petrie Professor of Law at Harvard Law School and Founding Director of the Petrie-Flom Center for Health Law Policy, Biotechnology, and Bioethics. He specializes in antitrust, contracts, corporate law, and health law policy. His research addresses issues like horizontal shareholding, statutory interpretation, and antitrust economics. Elhauge has been a visiting professor at institutions like the University of Chicago and Yale Law School and served on the Obama Campaign’s Antitrust Advisory Committee.
Education: J.D. (1986) and A.B. (1982) from Harvard, graduating first in his law class. He clerked for Justice William J. Brennan Jr. and Judge William A. Norris. His books include U.S. Antitrust Law and Economics and Obamacare on Trial.
Research interests span antitrust law’s economic foundations, healthcare policy, and statutory interpretation. His work on horizontal shareholding highlights how shared ownership among competitors distorts markets. He critiques legal doctrines like contractual duress and unconstitutional conditions in Contrived Threats v. Uncontrived Warnings.
Publications include over 35 articles and books, with recent works addressing loyalty discounts, patent settlements, and Google Books settlement antitrust implications. His awards include the Jerry S. Cohen Memorial Fund Writing Award and recognition for teaching and scholarship.
