Einer Elhauge is the Petrie Professor of Law at Harvard Law School and Founding Director of the Petrie-Flom Center for Health Law Policy, Biotechnology and Bioethics. He has been a faculty member at Harvard Law School since 1995 and holds the distinguished Carroll and Milton Petrie Professorship since 2005.
Professor Elhauge received his A.B. from Harvard College in 1982 and his J.D. from Harvard Law School in 1986, where he graduated first in his class. His legal career includes prestigious clerkships with Justice William J. Brennan, Jr. on the Supreme Court, Judge William A. Norris on the Ninth Circuit Court of Appeals, and at the U.S. Solicitor General's Office.
His research spans a broad range of legal fields including antitrust law, contracts, corporate law, health law policy, and statutory interpretation. Professor Elhauge has developed influential theories on statutory default rules, horizontal shareholding, and contractual duress, with his work frequently cited in academic literature and legal proceedings.
His recent publications demonstrate continued leadership in antitrust scholarship, with his 2023 article on managerial objective functions addressing cutting-edge issues in corporate governance and competition policy. His textbook U.S. Antitrust Law and Economics remains a standard reference in the field, now in its fourth edition (2022).

Before joining Harvard, Professor Elhauge was a Professor of Law at the University of California at Berkeley from 1988 to 1995, and has held visiting positions at the University of Chicago Law School, Harvard Law School, and Yale Law School, establishing him as a prominent figure in legal academia with national influence.
