Marie-Laure Basilien-Gainche is a Professor of Public Law at the Faculty of Law, Jean Moulin University Lyon 3, where she is part of the International, European and Comparative Law Team. She holds the prestigious position of Senior Member of the Institut Universitaire de France and serves as a Member of the Institut Convergences Migrations and the Scientific Committee of the EU Agency for Fundamental Rights. Her academic profile is further enhanced by her recognition as a Laureate of the Fondation pour les Sciences Sociales.
Her research focuses on critical intersections of public law, migration governance, and fundamental rights protection. Key areas include European Union Law, Migration Law, Human Rights Law, Rule of Law principles, and States of Exception. Her work critically examines how European migration policies increasingly normalize exceptional legal regimes while eroding fundamental rights protections, with particular attention to border management practices and the concept of 'border thickness'.
Her scholarly output reveals a consistent trajectory analyzing how European migration governance operates through domination rather than legitimate authority, examining the legal mechanisms that enable exclusionary practices while maintaining formal adherence to rule of law principles. Recent publications focus on the European Migration Pact, French immigration legislation, and the impact of the pandemic on constitutional safeguards.
