Associate Professor Cheryl Foong is a leading academic in Intellectual Property (IP) and Technology Law at Curtin Law School, Curtin University. She holds positions as Co-Director of Research & Innovation and serves in the Office of the Provost. Her work focuses on copyright law in digital environments, including artificial intelligence, streaming technologies, and global IP harmonization. She teaches IP law, competition law, and has authored influential books like The Making Available Right, cited by the Supreme Court of Canada. Her research bridges legal theory and policy, addressing challenges in digital dissemination and exclusive rights overlap. Awards include the Dean's Colleague Award (2022) and Fellowship of the Higher Education Academy (2021). She has held visiting roles at Osgoode Hall Law School (Toronto), Texas A&M, and Aberdeen University. Cheryl’s outreach includes pro bono IP clinics for artists and startups, and submissions to Australian government reviews on copyright law reform.
Educations: LLB (Hons I), LLM (QUT), LLM (Columbia), PhD (ACU). Research interests include international IP law, competition law, and digital rights. She is a member of ATRIP, APCA, and LESANZ. Teaching spans undergraduate and postgraduate programs in IP management, commercialization, and competition policy.
Her recent articles analyze Canada’s SOCAN v ESA case, AI and copyright, and the evolution of Australia’s site-blocking regime. She frequently presents at global conferences, including WIPO and the Asian Pacific Copyright Association. Cheryl advocates for sustainable limits on copyright rights to address digital age challenges while balancing creator and public interests.
