Malcolm Thorburn is Professor of Law and Chair in Law and Innovation at the University of Toronto Faculty of Law. He holds the 2024–2027 Pierre Elliott Trudeau Foundation Fellowship and has previously been the Nathaniel Fensterstock Visiting Professor at Columbia Law School (2025) and the Robert S. Campbell Visiting Professor at Magdalen College, Oxford (2011–2012). His research explores theoretical dimensions of criminal law, constitutionalism, policing, and sentencing.

Research Interests
Thorburn’s scholarship interrogates the moral and constitutional foundations of criminal law. His work on criminal law as public law examines how coercive state power must be justified through public authority rather than private morality. He investigates the legitimacy of policing powers, the proportionality of sentencing, and the fiduciary duties owed by the state to its citizens.
A second strand of research focuses on constitutional limits, analysing how Charter rights constrain criminalisation and punishment. His comparative projects explore how different legal cultures balance security and liberty, contributing to debates on crimmigration, surveillance, and restorative justice.

Across nearly two decades, Thorburn’s articles trace an arc from foundational questions of authority to applied issues of policing and sentencing. Early work in the Yale Law Journal (2008) established his theory of legal justifications, while later pieces in the University of Toronto Law Journal (2019–2020) extend this framework to police governance and penal legitimacy.
