Eric A. Posner is the Kirkland & Ellis Distinguished Service Professor of Law at the University of Chicago Law School, where he has held faculty positions since 1998, progressing from Professor of Law to his current distinguished professorship. He is affiliated with the Coase-Sandor Institute for Law and Economics and contributes to Public Service and Public Interest Law programs.
Professor Posner earned his JD magna cum laude from Harvard Law School in 1991 and his BA and MA in philosophy summa cum laude from Yale University in 1988. His professional experience includes clerkship with Judge Stephen F. Williams on the DC Circuit Court of Appeals, work as Attorney Adviser at the Office of Legal Counsel, and service as Counsel to the Assistant Attorney General in the Antitrust Division of the Department of Justice.
Posner's research spans antitrust law, financial regulation, international law, and constitutional law, with recent work focusing on labor market power, the intersection of antitrust and inequality, and the political foundations of legal doctrines. His scholarship often bridges law and economics, examining how legal rules shape market outcomes and social welfare. He has published extensively in top law reviews and economics journals, frequently collaborating with leading scholars across disciplines.
His recent publications reveal a clear trajectory toward examining how concentrated market power affects workers and consumers, with numerous articles challenging traditional consumer welfare standards in antitrust law.
