Eva E. Subotnik is a Professor of Law and Associate Dean for Faculty Scholarship at St. John’s University School of Law, where she has served since 2011. She teaches courses in Copyright Law, Intellectual Property Survey, and Trusts & Estates. Her research focuses on artistic intent in copyright law, particularly regarding photography, fair use, and posthumous control of creative works. She directs the St. John’s Intellectual Property Law Center (IPLC), advancing interdisciplinary scholarship in IP law.
Subotnik earned a B.A. summa cum laude from Columbia University (1997) and a J.D. from Columbia Law School (2003), where she was an editor of the Columbia Law Review. She clerked for Judges Bruce M. Selya (1st Circuit) and Alvin K. Hellerstein (SDNY). Before joining St. John’s, she was an Intellectual Property Fellow at Columbia’s Kernochan Center and practiced corporate and litigation law at Debevoise & Plimpton in New York.
Her scholarship addresses intersections between copyright law, authorship, and cultural heritage, with notable contributions to debates on fair use, postmortem rights, and photographic subjectivity. Recent work critiques gaps in copyright policy and explores legal frameworks for artistic legacy management.
Subotnik’s academic leadership includes fostering collaboration between scholars, practitioners, and policymakers through the IPLC. Her research has appeared in leading journals such as the Notre Dame Law Review, Washington Law Review, and Harvard Journal of Law & Technology.
