Emily Bremer is a Professor of Law at the University of Notre Dame’s Law School, specializing in administrative law, regulatory processes, and civil procedure. She holds affiliations as a Senior Fellow at the Administrative Conference of the United States (ACUS), co-editor of the Administrative Law section of Jotwell, and a contributor to the Yale Journal on Regulation’s Notice & Comment blog. Her research focuses on procedural design, particularly the history and interpretation of the Administrative Procedure Act (APA).
She earned degrees from New York University (undergraduate) and NYU School of Law. Prior to academia, she served as Research Chief at ACUS, practiced telecommunications law in Washington, D.C., and clerked for Judge Andrew J. Kleinfeld on the Ninth Circuit Court of Appeals.
Her notable awards include the AALS’s junior scholar award for administrative law and the AALL’s Legal Literature Award for the Bremer-Kovacs Collection, a HeinOnline database on APA history. Her scholarship includes Virginia Law Review’s upcoming constitutional analysis of APA adjudication provisions, Yale Journal on Regulation articles on administrative law’s practical realities, and twin studies on APA’s foundational provisions.
Bremer advises ACUS on regulatory reforms and teaches courses on Administrative Law, Civil Procedure, and Regulatory Process. Her work has informed agency policies on declaratory orders, incorporation by reference, and jurisdictional limitations.
