Edward T. Swaine is the Charles Kennedy Poe Research Professor at the George Washington University Law School. He teaches and writes in the areas of international law, foreign relations law, international antitrust, and contracts. Professor Swaine joined the GW faculty in 2006, after serving as the Counselor on International Law at the U.S. Department of State. His prior academic appointment was at the Wharton School with a secondary appointment at the University of Pennsylvania Law School.
Professor Swaine earned his BA from Harvard University and his JD from Yale University, where he served as Editor-in-Chief of the Yale Law Journal. His educational background has provided a strong foundation for his scholarly work at the intersection of international and constitutional law.
Professor Swaine's research focuses on how international legal obligations interact with domestic constitutional structures. His scholarship explores treaty law, customary international law, and the constitutional dimensions of foreign relations, often employing interdisciplinary approaches that incorporate insights from political science and economics. He has made significant contributions to understanding presidential power in international affairs, the role of custom in international law, and the application of antitrust principles in global contexts. His work demonstrates how international legal frameworks impact domestic governance structures and vice versa.
Professor Swaine's recent publications, including 'Presidential Power to Exit Treaties: Reflecting on the Mirror Principle' (2024), reveal a consistent focus on the tension between international legal obligations and domestic constitutional constraints. Professor Swaine has held significant leadership roles at GW Law, including Senior Associate Dean for Academic Affairs and Director of the Competition Law Center. He co-directs the GW-Oxford International Human Rights Law Summer School, demonstrating his commitment to international legal education. His practical experience includes consulting on matters involving treaty law, antitrust, intellectual property, and international litigation and arbitration, which informs his scholarly work. Before entering academia, Professor Swaine practiced law at Cleary, Gottlieb, Steen and Hamilton in Brussels, focusing on European Community law and antitrust, and served in the civil appellate staff at the U.S. Department of Justice.
