Randy J. Kozel is the Fritz Duda Family Professor of Law and Associate Dean for Faculty Development and Academic Affairs at the University of Notre Dame Law School. He joined the faculty in 2011 and directs the Notre Dame Program on Constitutional Structure. His research focuses on constitutional theory, free speech, judicial decision-making, and statutory interpretation. Kozel holds a J.D., magna cum laude, from Harvard Law School, where he served on the Harvard Law Review. He clerked for U.S. Supreme Court Justice Anthony M. Kennedy and Judge Alex Kozinski of the 9th Circuit. His book, Settled Versus Right: A Theory of Precedent (Cambridge 2017), critiques and rethinks judicial reliance on precedent. Kozel teaches courses including Contracts, Freedom of Speech, and Statutory Interpretation.
His scholarly work addresses topics like stare decisis, administrative deference, and the role of precedent in constitutional law. Recent articles include analyses of Chevron deference and the Bruen test in Florida Law Review and Second Thoughts Blog. Kozel’s contributions bridge theoretical legal scholarship with practical judicial methodologies, emphasizing legal continuity and institutional legitimacy.
