David Upham, PhD, JD, is an Assistant Professor of Politics and Senior Fellow in Politics and Law at the University of Dallas. He holds a J.D. from the University of Texas School of Law and a PhD from the University of Dallas, alongside multiple master's degrees and a political studies certificate from Sciences Po Paris. His research focuses on constitutional law, originalism, and the Fourteenth Amendment, with notable work on citizenship rights and historical legal interpretation.
Dr. Upham teaches courses including Constitutional Law, American Political Thought, and seminars on the Fourteenth Amendment. His scholarly contributions address topics such as substantive due process, religious expression in schools, and the original understanding of key constitutional clauses.
In litigation, he has advised on cases involving religious freedoms in public schools, such as the Morgan v. Swanson ('Candy Cane Case'), advocating for school officials' qualified immunity. His legal writing critiques judicial overreach and emphasizes fidelity to constitutional text and history.
